These terms govern your use of swayhome.com.au and any purchase you make from us. Please read them before you order. By placing an order you agree to them.

Prices

All prices are in Australian dollars and include GST. Prices shown on this site are for the furniture only and do not include delivery, which is quoted separately to your address. We may change prices at any time, but a price we have quoted to you in writing holds for the period stated in the quote.

Quotes

A delivery quote is valid for 14 days from the date we send it, unless we say otherwise. A quote is not an order and does not reserve stock. Stock is allocated when payment is received, so a piece shown as in stock when we quote may sell in the meantime. If that happens we will tell you immediately and refund anything you have paid.

Orders and payment

Your order is an offer to buy. A contract is formed when we accept your order and payment has cleared, not when you submit the quote request.

In-stock pieces are paid in full before dispatch.

Made-to-order pieces are paid in full at the time of order. Once your order is placed with the Pacific Green workshop it cannot be cancelled or changed, because the piece is built to your specification and cannot be resold. Your rights under the Australian Consumer Law are unaffected.

We may decline or cancel an order — for example where a piece is no longer available, where there has been a pricing or description error, or where we cannot deliver to your address. If we do, we will refund you in full.

Title and risk

Ownership of a piece passes to you when we have received payment in full. Risk passes to you on delivery. Between those two points the piece is at our risk, not yours.

Delivery

Delivery is governed by our Shipping & Delivery page, which forms part of these terms. Delivery timeframes are estimates. We are not liable for delays caused by container schedules, customs, carriers, weather or anything else outside our reasonable control, but we will keep you informed.

You are responsible for telling us accurately about access at your address and for checking that the piece will fit. Where a delivery fails because the piece will not fit or access differs materially from what was described to us, a further delivery attempt is charged at cost.

Product descriptions and images

We describe our pieces as accurately as we can. Palmwood is a natural material and grain, colour and density vary from piece to piece; leather carries natural markings. Photographs and screen colours are indicative. This variation is a characteristic of the material, not a defect.

Dimensions are given in millimetres and are approximate, with a tolerance of around 20 mm on handmade pieces. If a dimension is critical to your space, ask us to confirm it before you order.

Your consumer rights

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit our liability, we limit it to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so — at our option.

Subject to that, we are not liable for indirect or consequential loss, including loss of profit or loss of opportunity.

Trade customers

Purchases made on a trade account are subject to the trade terms we issue when the account is opened. Where those terms conflict with these, the trade terms prevail. Goods bought for commercial use may not attract the same consumer guarantees as goods bought for domestic use.

Using this website

The content of this site, including text, photographs and design, belongs to us or to Pacific Green and is protected by copyright. You may not reproduce it commercially without our written permission. We try to keep the site accurate and available but do not guarantee that it will be uninterrupted or error-free.

Privacy

We handle your personal information in accordance with our Privacy Policy.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.

Changes

We may update these terms from time to time. The version in force is the one published here when you place your order.
